Cafe Registration Terms & Conditions

The Barista Placement Program (“Program”) is a service provided by Toby’s Estate whereby Toby’s Estate introduces baristas registered in the Program (“Baristas”) to cafes, restaurants or other F&B establishments seeking to fill part-time or full-time barista positions.

Taking part in the Program is completely optional and voluntary.

If you are a café, restaurant or other F&B establishment wishing to take part in the Program, you must register with Toby’s Estate and agree to all the Terms & Conditions which include the following specific terms and conditions of the Program.

Toby’s Estate has the right not to enroll you in the Program or remove/disqualify or suspend you from the Program if you do not comply with the Terms & Conditions.

Toby’s Estate does not guarantee the availability or suitability of any Baristas and will not be liable to you if during your participation in the Program, there are no suitable Baristas available for introduction and/or placement.

Toby’s Estate does not endorse or recommend any Barista introduced and we strongly recommend that you obtain your own independent legal, financial, employment or other appropriate advice before offering any job position to or entering into any employment agreement with a Barista. You are solely responsible to evaluate the accuracy, completeness, suitability, usefulness of any information provided to you through the Program including information on the Barista’s experience or qualifications and Toby’s Estate will not be liable to you for any decision or action taken by you in reliance of such information.

Any job position or employment you offer to a Barista is made solely by you and any employment agreement or service agreement is between you and the Barista and does not in any way involve Toby’s Estate. Toby’s Estate is in no way liable or responsible for wage negotiations, employment terms negotiations or for any payments or benefits you offer to a Barista.

By registering in the Program, you agree to pay the following fees to Toby’s Estate:

Placement Fee	Australian Dollars
Part-time position	45.00 X agreed number of days of the part-time position.	The Placement Fee is payable if you agree to a placement i.e. you agree to hire or employ any Barista introduced to you by Toby’s Estate, whether for a current job position or at any time in the future.
Full-time position	300.00
Additional Fee for urgent placement:	35.00	The Additional Fee is payable if you give Toby’s Estate less than 24 hours notice to place a suitable Barista with you.
Cancellation Fee	Equivalent to Barista’s first day agreed wages	The Cancellation Fee is payable if you cancel a confirmed Barista placement and give Toby’s Estate less than 48 hours notice of such cancellation.

Barista placements are not confirmed until Toby’s Estate receives full payment of the Placement Fee and the Additional Fee (if applicable).

If a Barista placement is confirmed but the Barista fails to arrive for the job position as agreed ("No-Show"), the Placement Fee will be refunded to you in full. Refund of the Placement Fee shall be your sole remedy for a No-Show and Toby’s Estate shall not in any way be liable to you for any loss, costs or expenses you may incur resulting from a No-Show.

Except in the case of a refund for No-Show, all monies paid to Toby’s Estate are final and non-refundable.
